OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

By participating in the Gillz/ Reel Life  Florida Keys Sweepstakes (the “Sweepstakes”) you agree to be bound by these Official Rules, and the decisions of Gillz, LLC (“Gillz”), which are binding and final in all matters relating to this Sweepstakes.

 

1. Eligibility. This Sweepstakes is open to all legal residents of the Continental United States who are at least 18 years of age. Employees of Gillz and of any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of this Sweepstakes and of each of their respective parents, agents, affiliates, subsidiaries, and advertising and promotion agencies, and those employees’ immediate family members (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win. “Immediate family members” means spouses, parents, step-parents, children, step-children, siblings, step-siblings, and their respective spouses. “Household members” means people who share the same residence at least three months a year.  Government-issued identification card must match entry data. Entries are void where prohibited.

 

2. Sweepstakes Period. The Sweepstakes begins at 12:00 a.m. ET on October 8, 2020, and ends at 11:59 p.m. ET on December 18, 2020 (the “Sweepstakes Period”).

 

3. Prize and Sweepstakes Details. The winner of this Sweepstakes will receive a three (3) day fisherman’s dream trip in Marathon, Florida, for themselves and three (3) guest of their choice, at a time of their choosing during the 2021 calendar year. The trip includes (i) a two (2) night stay at the Isla Bella Beach Resort & Spa Florida Keys, (ii) a full-day, all-expenses paid fishing trip with Two Conchs Charters, (iii) admission to the Florida Keys Aquarium Encounters, and (iv) Gillz gear and apparel. The winner and his/her guests are responsible for all transportation costs and expenses to and from Marathon, Florida, and any incidental costs and expenses incurred while on the trip, including, without limitation, the cost of food, beverages, and souvenirs.  The price has a retail value which is less than Five Thousand Dollars ($5,000.00).

 

4. Entry; Registration. To enter this Sweepstakes, visit www.gillz-gear.com (the “Website”) during the Sweepstakes Period, and follow the instructions provided to submit a completed online entry form. Entries that are incomplete or do not adhere to these Official Rules may be disqualified by Gillz, in its sole discretion. Note that the Website referenced within these Official Rules may not be the only website (i.e., specific URLs) used to promote this Sweepstakes. If the promotional ad you see in a magazine, or other website or hyperlink that you follow online to enter this Sweepstakes refers to these Official Rules, then such website shall be considered a “Website” for purposes of this Sweepstakes.

 

You may only enter once. Entries generated by script, macro or other fraudulent or automated means or by any practices or means that subvert the entry process will be void if discovered by Gillz. All entries must be received before the end of the Sweepstakes Period to be eligible. All entries received become the property of Gillz and will not be returned.

 

Gillz reserves the right, in its sole discretion, to: (i) verify any element of any entry, related materials or entrant’s eligibility; (ii) to request additional information; and (iii) to disqualify any entrant whose participation may subject the Sweepstakes, Gillz, or any of the Sponsors, advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. By entering this Sweepstakes, you agree to provide any documentation or information deemed necessary by, and in a form acceptable to Gillz, to satisfy the above requirement if asked by Gillz to do so.

 

By participating in this Sweepstakes, you represent and warrant that you are a natural person who is assigned the e-mail address disclosed by the ISP, on-line service provider, or other organization responsible for assigning email addresses, and that all information submitted by you in your online entry form is true, accurate, and complete in all respects.

 

5. Administration. A potential winner will be selected by a random drawing, under the supervision of Gillz. Gillz will attempt to notify the potential winner via email and telephone within five (5) days following the selection of the potential winner. Each potential winner must respond within five (5) days of Gillz’s initial notification attempt. Potential winners must provide Gillz with (i) a valid government-issued identification card, (ii) a completed IRS W-9 form, and (iii) a completed Sweepstakes Release of Liability/Publicity form signed by the potential winner and each guest (collectively the “Required Documents”), within ten (10) days of the date of notification, or by such later date as determined by Gillz, in its sole discretion. If the Required Documents are not returned within the specified period of time, or if the potential winner cannot be contacted and/or fails to timely claim the prize within the period provided above, then the prize shall be forfeited and an alternate winner may be selected by random drawing from the remaining eligible entries. Notwithstanding anything herein to the contrary, Gillz shall have no liability for the potential winner’s failure to receive notices due to spam, junk, email, or other security settings or for the potential winner’s failure to provide correct or accurate information in its entry.

 

6. Conditions to Winning. THE WINNER IS RESPONSIBLE FOR ALL FEDERAL, STATE, AND LOCAL TAXES AS APPLICABLE. Prize winners will be issued an IRS 1099 tax form in the amount of the prize’s fair market value as stated herein.  Gillz may require the winner to winner to pay any withholding taxes prior to delivering the price.  Any expenses not specifically provided for herein are the responsibility of the prize winner. The prize is non-transferable, non-negotiable, and not redeemable for cash. If any prize becomes unavailable for any reason, Gillz reserves the right to substitute a prize of comparable value. If the winner is not able to attend, or otherwise fails to use or redeem any element of the prize, the winner will forfeit the prize (or such prize element) and no additional or substitute prize or compensation will be provided. All properly claimed prizes will be awarded, but in no event will Gillz award more prizes than are provided for in these Official Rules.

 

7. Privacy. Registration is required to enroll in this Sweepstakes. When you register, Gillz collects personally identifying information about you, including your name, complete mailing address, phone number, and email address. The information that you provide will be added to a centralized database. By entering and providing the required registration information, you acknowledge that Gillz may send you information, samples, or special offers it believes may be of interest to you relating to goods or services offered by Gillz. By enrolling in the program you authorize Gillz to share your personal information with third parties to help Gillz use your personal information, as described above. You further authorize Gillz to share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information that Gillz may receive, or to otherwise protect Gillz’s rights. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, PLEASE DO NOT ENTER THIS SWEEPSTAKES.

 

8. Release. By participating in this Sweepstakes, you agree to release Gillz and the Sponsors, and each of their respective shareholders, officers, directors, employees, agents, independent contractors, parents, affiliates, subsidiaries, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liabilities, actions, claims, injuries, losses or damages arising in any manner, in whole or in part, directly or indirectly, from participation in this Sweepstakes. You further agree that the Released Parties are not responsible for lost, incomplete, damaged, inaccurate, stolen, undelivered, garbled or misdirected entries or registrations; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties that may occur in connection with the administration of the Sweepstakes. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the administration of the Sweepstakes.

 

9. Disputes. By participating in this Sweepstakes, you agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes must be resolved individually, without resort to any form of class action, and any judicial proceeding will take place in a federal or state court within the State of Florida and you hereby irrevocably consent to the jurisdiction and venue of such courts within the State of Florida; (b) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual damages, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations in connection with the Sweepstakes, will be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Florida.

 

10. No Representations and Warranties. By enrolling in the Sweepstakes, you understand and acknowledge that Gillz makes no representations or warranties whatsoever about the Sweepstakes, or its products and services, whether express, implied, at common law, or by statute, including, without limitation, any warranty of merchantability or fitness for a particular purpose, and Gillz expressly disclaims all liability and responsibility for any representation, warranty, statement, or information made or communicated (orally or in writing) to you by any Sponsor employee, agent, independent contractor, or representative of Gillz.

 

11. Additional Terms. Gillz reserves the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct or technical failures destroy or threaten the integrity of the Sweepstakes, in the sole opinion of Gillz, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes, as determined by Gillz, in its sole discretion. If Gillz terminates the Sweepstakes, Gillz will determine the winner by random drawing from among all eligible, non-suspect, non-winning entries received as of the termination. If Gillz cancels, modifies, or terminates the Sweepstakes, Gillz will post notice of its action on the website. Neither the failure of Gillz to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Gillz in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Gillz’s right to assert or rely upon any such provision or right in that or any other instance. If there is any conflict between any term of these Official Rules and any marketing or entry materials used in connection with the Sweepstakes, the terms of these Official Rules will govern.

 

12. Sponsors. The Sweepstakes’s sponsors are Gillz, Two Conchs Sport Fishing TV Inc., Isla Bella Beach Resort & Spa Florida Keys, and Florida Keys Aquarium Encounters.

 

13. Social Media. This Sweepstakes is hosted by Gillz and in no way is it sponsored, endorsed, administered by, or associated with any social media platform, including without limitation, Facebook, Twitter or Instagram.

 

14. Winners List. To obtain a copy of the winner’s name or a copy of these Official Rules, please mail your request, along with a separate, self-addressed, stamped envelope to:

15. Severability. In case any one or more of the provisions contained herein shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision of these Official Rules, and these Official Rules shall be construed as if such invalid, illegal or unenforceable provisions had not been contained herein.
